Investigation group on Andijan events condemns UNHCR for violating international norms

"An investigation group of Andijan Regional prosecutor's office is currently carrying out investigation in relation to them [those five Uzbek citizens who had been handed over by the Kyrgyz authorities to Uzbekistan that were accused of carrying out acts of terrorism in Andijan] on a criminal case that was brought on Articles 155, part 3, paragraph a, b (terrorism, death of man and other heavy consequences), 159, part 3, paragraph b (encroachment on the constitutional system, organized by a group or in its interests) 242, part 2 (the setting up of organized armed group), and also on a number of other articles of the Criminal Code of the republic", the Press-uz.info news agency was told by a source in the General Procurator's office of Uzbekistan on Monday [14 August].

According to the source, the investigation had data at its disposal that one of the accused, Rasuljon Pirmatov was an active member of the religious- extremist trend "Akromiylar". In the course of May events he participated in the armed attack on the battalion of the patrol and inspection service of the Regional Interior Affairs Directorate. Then, he participated in the attack on the prison in the composition of a criminal group, where from over 500 prisoners were released. R. Pirmatov is also being charged with the participation in the seizure of Andijan Regional administration building. There he organized distribution of the seized weapon that had been kept in his car to members of a criminal group

Together with other accused that had been extradited from Kyrgyzstan, Jahangir Maksudov and Odiljon Rahimov, they brought to the meeting the public prosecutor of Andijan city, Gani Abdurahimov, who had been taken hostage and later was killed by terrorists. Odiljon Rahimov is charged with the participation in the seizure of prison and the Regional administration building. He participated in the preparation of explosives.

Very dangerous recidivist, having two previous criminal convictions, Yakub Tashbayev, was amongst those criminals who had been handed over by the Kyrgyz authorities to Uzbekistan. Early morning on 13 May he was freed from the prison, where had served his sentence for 14 years for drug smuggling and other crimes. When he was freed from the prison and armed, he joined the terrorists.

Meanwhile, the expert of the Fund for regional policy, Aktam Jalilov, emphasizes that "having handed over the accused in heavy crimes to Uzbekistan, Kyrgyzstan fulfilled its obligations both within the framework of international and bilateral relations".

In his opinion, this is a convincing example of cooperation between the two adjacent countries in combating international terrorism and extremism.

"We understand perfectly that the UN High Commissioner for refugees [UNHCR] and some states exerted unprecedented pressure on Kyrgyzstan's authority", he said. Meanwhile, the analyst notes that in this case the policy of dual standards by certain western states again clearly appeared.

"Why in our case it is possible to justify the actions of criminals, who seized weapons and hostages, and killed people, irrespective of the motives they had been guided to do so? Is it possible to visualize a similar relation to those accused in the crimes in the West ", he emphasized.

The analyst considers that the current activation of religious - extremist, and terrorist groups in the area became to a certain degree the consequence of this policy of "dual standards".

"This can serve as dangerous detonator for destabilizing the situation in Central Asia", he said.

Aktam Jalilov recalled that in spite of the fact that Uzbekistan had submitted the unquestionable materials on the involvement of 15 Uzbek citizens in the terrorist acts in Andijan, the UNHCR, having ignored the standards of contemporary international law, confidentially evacuated 11 out of this number into the third countries. He also focused attention on the fact that the UNHCR had been officially informed about the fact that Uzbekistan raises the question about the returning of only those persons, who escaped from the prisons or committed criminal punishable acts that were recognized by all countries of the world. Namely: intentional murder, terrorism, illegal possession of weapon and ammunition, encroachment on the constitutional system, the seizure of hostages, the involvement in the activity of forbidden organizations.

In the opinion of the expert, the UNHCR ignored rights and obligations of Kyrgyzstan and Uzbekistan, provided by the United Nations Charter, by regulations of chapter F of article 1 on the convention on refugees' status of 1951. He also noted that another fact was also not taken into account that both countries are participants in the Minsk convention of 1993 "On legal aid and legal relations in the civil, family and criminal cases", they both have obligations on combating terrorism within the framework of SCO [Shanhai Cooperation Organization].

"It is seemed that actually the UNHCR has been used as the cover of forces of international terrorism", Aktam Jalilov said.

He also emphasized that the UNHCR's activity in Kyrgyzstan created dangerous precedent of abuse of universally recognized principles on the right of refugees and humanitarian right by this international structure and by some states for political purposes. The UNHCR's actions led to disturbance of nonintervention principle into the internal affairs of sovereign state and the exceeding of mandate and politization of the UNHCR's activity.

"The handing over of those accused in the crimes in the territory of Uzbekistan by Kyrgyzstan again demonstrated that for the peoples of the two countries friendship and friendly relations, peace and stability, are more important than intrigues of some international organizations", Aktam Jalilov concluded.
